New York has more than 79 categories of Peace Officers, law enforcement officers vested with powers of arrest and authorized to carry weapons, that span the gamut of Deputy Sheriffs to Park Rangers, however unique among these more than 79 categories of peace officers are agents or officers of a society for the prevention of cruelty to animals. These officers are unique in that while they are sworn law enforcement officers vested with the power of arrest and other authority, they, unlike any other category of Peace Officer, work for a private not-for-profit, not a government agency, police department or law enforcement agency.

Agents or officers of an incorporated society of prevention of cruelty to animals are on the front lines of protecting, rescuing and sheltering pets and other animals that have been abused, abandoned or orphaned and are charged with enforcing the Agriculture and Markets law in New York State and other state and local laws pertaining to animal cruelty.
Agents and Officers of a duly organized or incorporated society for the prevention of cruelty to animals are peace officers under New York State Criminal Procedure Law §2.10 and therefore have the power of arrest, the power to issue summons or desk appearance tickets and the power to possess weapons including firearms and other weapons. However, they are not government employees and so are in a unique position. Many of these officers may volunteer their time or work part time to protect our State’s animals.
There are many different societies for the prevention of cruelty to animals operating throughout New York State with hundreds of officers working sometimes around the clock.
New York Agriculture and Markets Law defines numerous criminal laws that punish various types of animal cruelty. These laws impose potentially severe fines, jail sentences and the possibility of State Prison sentences. Officers enforcing these laws face risks at least as great as other peace officers but do not have the same protections associated with being a government employee.
